ORIGINAL - PUBLIC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-t 993-050 <br />INSPECTION DATE: 12/29/nR INSPECTORS INITIALS: RK <br />OBSERVATIONS <br />The Division conducted a monitoring inspection of the site as part of sites to be <br />inspected during the fiscal years 2008-2009. Present during the inspection was Mr. Mike <br />Asbury of Pioneer Sand. <br />1) Site is a large phased (12 phases) sand and gravel operation located west of I-25 along <br />the Baptist Road exist. Total permit area 146 acres. Total maximum affected area for the <br />life of mine is 64 acre. Maximum affected area at any given time 11.2 acres. <br />2) Site was active at the time of the inspection, in Phases X AND XI. A front end loader <br />and screen were noted along the active pit area. Approximately 3-5 acres appeared to be <br />active at the time of the inspection. The pit high wall measured approximately 15 feet <br />extending North to south. <br />3) A large stockpile of processed material was noted along the North Eastern portion of <br />the access road. <br />4) In 1999 a TR was approved changing the access road for Phase VII through XII and also <br />approve placement of visual screening berms. Berms were in place and no problem noted. <br />5) When site was last inspected in 2001, to verify compliance of the two possible problems <br />identified in the pervious inspection report of lack of affected boundary marker and the <br />sediment pond located east of the scale house, being full of sediment, which were complied <br />with, no additional problems were noted at that time. <br />6) According to the annual report and what was observed on site, most of the affected <br />acreage along the east side of the permit area covering Phases I through VI, appeared to <br />have been reclaimed. Some grass growth was noted at the time of the inspection. However, <br />it was not clear to identify how many of these acres were reclaimed. In order for the DBMS <br />to properly evaluate the financial warranty needed for the site, which at the present time <br />is only #25,200.00, DRMS will need an accurate survey of the total affected areas, <br />including the reclaimed acres, and proposed to be affected next year. Until a reclaimed <br />acres are released they are considered affected. DRMS CAN ADJUST THE WARRNTY GIVING CREDIT <br />FOR AREAS RECLAIMED BUT NOT RELEASED THROUGH THE WARRANTY REDUCTION PROCESS in accordance <br />with Rule 3.1.3 of the Construction Materials Rules and Regulations. <br />7) No offsite drainage patterns were noted at the time of the inspections. The small <br />sediment pond located east of the scale house was holding some sediment, but was dry and <br />appeared to have enough free board. The Division assumes the operator is in compliance <br />with their CDOH&E approved storm water discharge permit. <br />8) Permit sign and boundary markers were properly posted. <br />I & E Contact Address <br />NAME: MR.
