_.I.1
TML Trapper Mine, bond release (SL-9Z pg. 2
Backfilling and grading activities have been demonstrated to be in compliance with the approved
DRMS mining permit and DRMS regulations and have been approved for release in previous
bond release applications. The final backfilling and grading configurations throughout the
affected areas closely resemble the approximate original contours of the land before mining,
blend well into the adjacent undisturbed landscapes, and revegetation efforts have been
successful. DRMS has routinely inspected the approximately 295 acres proposed for release.
This bond release requests applies to Phase II release for 294.6 acres of land (SL-9). No
reduction in the amount of bond held is sought with this bond release application. TMI proposed
a reduction of $898,333.00 in the amount of reclamation liability. TMI will not request a new
bond rider to actually release the amount under consideration, but will leave the money in surety
bond as a buffer against future bond obligations.
OSM finds TMI has met or exceeded the requirements for Phase II bond release on the acreages
noted above; and OSM hereby provides concurrance to release the bond acreages and amounts
set forth in the DRMS Proposed Decision.
DRMS currently holds a reclamation bond in the amount of $20,606,900.00. As a result of this
bond release, TMI's reclamation liability will be lowered to $19,479,903.00. DRMS will retain
the complete $20,606,900.00 performance bond. DRMS has determined the bond amount
remaining is adequate to ensure completion of the remaining reclamation and environmental
monitoring responsibilities.
Thank you and your staff for coordinating this Federal mine bond release through the DFD.
Please direct any questions concerning this bond release action to Christine Belka,
Environmental Protection Specialist, at cbelka@OSMRE.gov or to (303) 293-5020.
Sincerely,
J WVW (?
James.
