The Division of Reclamation, Mining, and Safety (Division) is required to make an <br />approval or denial decision no later than July 11, 2008, therefore, your response to the following <br />adequacy review concerns should be submitted to the Division as soon as possible. Any public <br />comments that we receive on your application during the interim will be forwarded to you. <br />As required by Rule 1.6.2 (1)(g), please submit the proof of publication of the public notice <br />circulated in the local newspaper (once the publication requirement of one publication per <br />week for four consecutive weeks) has been met. Please also submit to the Division proof of <br />notice for any and all individual landowner(s) (in the form of return receipts of a Certified <br />Mailing or by proof of personal service) for all owners of record of surface and mineral <br />lands, easement holders, and owners of record of surface lands that are within 200 feet of the <br />boundary of the affected land (i.e. Ada Haddock). <br />Application Package: <br />2. Please initial and return the enclosed pages (by numbers 1-10) of the application package that <br />were overlooked. <br />Rule 6.4.4 Exhibit D- Mining Plan <br />3. Please clarify the maximum acreage to be disturbed at any given point in time. Please be sure <br />that this acreage clarification is noted on all maps, as well as in the narrative of the <br />application. <br />4. Please state the owner of record for all existing permanent man-made structures (i.e. the <br />fence running along the eastern extent of the site, adjacent to the Haddock property).
