Cattany <br /> Division Director <br /> Natural Resource Trustee <br />TO: Dan Mathews <br />FROM: Mike Boulay Vtb- <br />DATE: December 30, 2008 <br />SUBJECT: Seneca Coal Company, Seneca 11 Mine (Permit No. C-80-005) <br />Phase II Bond Release Request (SL-3) Adequacy Review <br />I have reviewed Seneca Coal Company's (SCC's) responses to our December 18, 2008 letter <br />concerning the water quality demonstration presented in the SL-3 application. In SCC's response <br />letter (dated December 22, 2008) they have provided additional data as requested. For Pond 002, <br />they have provided water quality statistics for an "adjacent non-mined area" from the same <br />timeframe as the data presented for the 002 discharge in the SL-3 application since there are no pre- <br />mining data available. For Ponds 004 and 008 they were able to present a comparison of pre-mine <br />water quality with post-mine water quality for TSS. <br />I have checked SCC's analyses and find no problems with data presentation as submitted. The <br />amended information is adequate to demonstrate compliance with Rule 3.03.1(3)(b).
