<br />Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety proposes to APPROVE Trapper <br />Mining, Inc.'s application for permit renewal RN-05. <br />This decision is based on a finding that the operations will comply with all requirements of the <br />Colorado State Program as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. <br />34-33-101 et seq., and the Regulations promulgated pursuant to the Act. <br />If no request for a formal hearing is made within thirty (30) days of the first publication of the <br />issuance of this proposed decision, then this decision becomes final. The permit application, all <br />supporting documentation, and any stipulations or conditions will become a binding part of the <br />permit. <br />Stipulation No. 18: was previously attached to the permit. During the 2005 Midterm, Trapper <br />Mining, Inc. submitted a revision which called for the submittal and approval of an embankment <br />stability analysis demonstrating the embankment of deal gulch pond will have a minimum 1.3 <br />static safety factor in accordance with Rules 4.05.9(8)(b) and 2.05.3(4)(a)(ii)(B). Stipulation 18 <br />was complied with on July 13, 2006. <br />Stipulation No. 19: was previously attached to the permit. During the 2000 Midterm, Trapper <br />Mining, Inc. submitted a revision that called for a geotechnical monitoring and reporting plan for <br />drill holes by March 9, 2007. This stipulation was complied with on March 27, 2007. <br />Stipulation No. 20: During the 2005 Midterm, Trapper Mining, Inc. submitted a revision that <br />called for submittal of a reclamation plan and reclamation cost estimate for land disturbed by the <br />October 8, 2006 East Panel landslide that had not been previously approved for disturbance. <br />Trapper Mining, Inc. submitted PR-06 on November 07, 2007 to address Stipulation No. 20. <br />PR-06 was found incomplete on February 15, 2008. This Stipulation has not yet been complied <br />with. <br />Trapper Mine 4 July 25, 2006
