1. The Division previously granted a variance from topsoil removal in accordance with Rule <br />4.06.2(2)(a). Specific areas which the operator will not strip topsoil are limited to rocky <br />areas which occur over limited areas throughout the mine area. Each area approved is <br />handled separately as a minor revision to the permit and no general variance is currently <br />approved. <br />V. Sealing of Drilled Holes and Underground Openings <br />Sealing of wells, holes, and other openings is discussed in Section 3.3 of Vol. III of the <br />permit application. Trapper Mining Inc. has bonded for the sealing of up to 75 exploration <br />drill holes at an average depth of 170'. <br />1. The Division will require that each hole, well, or other underground opening be capped, <br />sealed, backfilled, or otherwise properly managed (4.07.3). <br />VI. Use of Explosives <br />The blasting plan, as well as other items related to blasting, is discussed in Section 3.4 of <br />Vol. III of the permit application. <br />The Division has previously approved blasting at times other than those described in the <br />blasting schedule due to unavoidable hazardous situations. These situations include <br />elimination of misfires, adverse weather, equipment failure, and safety related reasons. <br />(4.08.3(2)(b)(v) and (4.08.4(2)). <br />VII. Disposal of Excess Spoil <br />No specific approvals are granted to the applicant under this section. <br />VIII. Coal Mine Waste Banks <br />No specific approvals are granted to the applicant under this section. <br />IX. Coal Mine Waste <br />No specific approvals are granted to the applicant under this section. <br />X. Backfilling and Grading <br />Backfilling and grading is discussed under Section 3.5 of Vol. III of the permit application. <br />1. The Division previously approved the applicant's request for additional time for <br />backfilling and grading following coal removal in a contour strip mine. A detailed <br />written analysis under 2.05.4(2)(c) has demonstrated that additional time is necessary. <br />The applicant is bonded for a maximum of four (4) spoil ridges at any time within each <br />Trapper Mine 26 July 25, 2008
