13. The Division hereby approves the post-mining land uses of the operation. It was determined <br />that rangeland and cropland meet the requirements of Rule 4.16 for the permit area. <br />(2.07.6(2)(1)). <br />14. Specific approvals have been granted or are proposed. These approvals are addressed in the <br />following section, Section B. (2.07.6(2)(m)). <br />15. The Division finds that the activities proposed by the applicant will not affect the continued <br />existence of endangered or threatened species or result in the destruction or adverse <br />modification of their critical habitats. Bald eagles are winter residents of the mine area and <br />nesting Bald eagles have been documented in recent years at the Craig Municipal golf course <br />(approximately 4 miles north). Threatened species of fish exist in the Yampa River <br />downstream of the proposed mining operation. No impact to either of these species has been <br />observed from past mining activities at the Trapper Mine and none is projected. <br />(2.07.6(2)(n)). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As of <br />this time, Trapper Mining, Inc. is current in the payment of reclamation fees required by 30 <br />CFR Chapter VII, subchapter R. (2.07.6(2)(0)). <br />Part B - Findings required by Rule 4 <br />The following findings and specific approvals are required by Rule 4. <br />I. Roads - Rule 4.03 <br />A. Haul Roads <br />Haul roads are discussed under Section 3.7.2, Vol. III of the permit application. <br />The Division has previously approved a temporary ford of an ephemeral or <br />intermittent stream having a watershed of at least one square mile during the <br />construction period, being that it will not alter normal water flow, contribute <br />sediment, or adversely affect fish or wildlife. All road construction occurs <br />upstream of adequate sediment control facilities. The approved drainages for <br />this activity are Coyote, Johnson, No Name, and East Pyeatt. (4.03.1(2)(c)). <br />B. Access Roads <br />Access roads are discussed under Section 3.7.3, Vol. III of the permit application. <br />The Division previously approved specific fords of ephemeral streams in <br />watersheds of at least one square mile because they will not seriously alter <br />normal water flow, contribute to sediment load, or cause adverse affects to <br />fish or wildlife. The fords may occur in the Coyote, Johnson, No Name, and <br />Trapper Mine 20 July 25, 2008
