(hereinafter "Odin"), acquired fee title to property within <br />the boundaries of the Cresson Project proposed East Cresson Mine <br />(extension) and within the boundaries of the proposed pit itself. <br />The property consists of an undivided three-fifths interest in <br />the surface and in the minerals within the Newark J and Right All <br />Right patented mining claims (U.S. Mineral Survey No. 9075). <br />Cripple Creek & Victor Gold Mining Company (hereinafter "CC&V" or <br />"the Applicant"), owns the other undivided two-fifths of the <br />property so described. Neither mining nor reclamation of the <br />property is presently permitted by any agency of the State of <br />Colorado. <br />The Applicant requests that mining and reclamation of the <br />property so jointly owned by CC&V and Odin be so permitted <br />without regard to the Odin ownership of the majority interest <br />therein. The Applicant asserts that it can do so if it has any <br />interest therein, however large or small, citing "Colorado common <br />law" and a Colorado "special statute" as to "mining property" and <br />"Colorado common law" as to use of "the surface estate" as <br />follows: <br />On Page 34 of the Cresson Project Mining Development Plan, <br />Amendment 1, Attachment 1, under the heading "B.
