Ill. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> Creek Fansite Facility. The schedule for backfill and grading of the Hubbard Creek Fansite has not yet <br /> been determined. <br /> To soil <br /> Topsoil was stockpiled on the uphill side of the cut slope for the Ventilation and Utility Borehole pad <br /> recently developed (under TR-61 and MR-87). The sign for the southern pile was visible, but the posting <br /> for the northern pile appeared to have toppled over. <br /> General Mine Plan Compliance <br /> Access to the new borehole pad follows a steep road (the powerline road) upward to the southwest <br /> from the Bear Creek drainage. Drilling of the two boreholes has been completed (Figure 3). <br /> Reveaetation <br /> Seeding was accomplished the week prior to the inspection for the II West Coal Refuse slope and <br /> bench /access road (Figure 4). <br /> Air Resource Protection <br /> Road surfaces throughout the permit area were damp due to the recent precipitation. No potential <br /> threats to air quality were observed. <br /> Excess Spoil & Development Waste <br /> Coal mine waste continues to be hauled to the II West Coal Refuse Facility. Material dumped prior to <br /> the previous inspection has been compacted, and placement in the next lift has commenced (Figure <br /> 5). Rock and filter fabric are in place upstream of the filled area, for extension of the underdrain as the <br /> height of the fill increases (Figure 6). <br /> Reclamation Success <br /> The Somerset Mine portal area appears to be well vegetated and stable. <br /> This completes the December 2008 inspection report for the Elk Creek Mine. <br /> Elk Creek Mine C-1981-022 03-pec-2008 <br /> -2- <br />
