Ill. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a Partial Inspection of the New Horizon Mine conducted by Marcia Talvitie of the <br /> Colorado DRMS on the afternoon of 20-Nov-2008. Ross Gubka (RG) represented the operator, <br /> Western Fuels - Colorado (WFC), throughout the entire inspection. The weather was partly <br /> cloudy and cool. Aerial photographs were taken by Harry Ranney of the DRMS on 19-Nov-2008, <br /> one day in advance of the field inspection. <br /> Hydrologic Balance <br /> Pond 008-The CCC Ditch had been turned on earlier in the day (week?) to allow landowners in <br /> the area to fill their stock ponds for the winter. According to RG, WFC would be temporarily <br /> filling Pond 008 (Figure 1) with ditch water, for augmentation purposes. <br /> Pond 011 -This pond was discharging at the time of the inspection. Oil absorbent pads and a <br /> floating boom were observed at the inlet to the pond. No evidence of petroleum products <br /> could be seen (no sheen) on the pond surface. An aerial perspective of the area surrounding <br /> Pond 011 is given in Figure 2. <br /> Topsoil <br /> Disc-ing operations were observed on the topsoiled portions of the Lloyd parcel, in preparation <br /> for seeding which will occur later in the fall. <br /> Prime Farmland (Section 4.25) <br /> A new area of "A" Horizon topsoil from the Morgan parcel had been windrowed by a bulldozer, <br /> immediately west of the active mine area. In one location, the thickness was approximately 24 <br /> inches (Figure 3), and the color change to the "B" Horizon immediately below was apparent. <br /> Further to the north, there was no "B" Horizon - the topsoil rested directly upon sandstone <br /> bedrock (Figure 4). <br /> General Mine Plan Compliance <br /> The area of active mine operations is displayed in Figure 5.
