III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a Complete Inspection of the Hamilton Mine conducted by Marcia Talvitie of the <br /> Colorado DRMS on 20-Nov-2008. The inspection began with a records check at 10:30 a.m., <br /> followed by the field inspection at noon. The operator was not represented during the <br /> inspection. Weather conditions were partly cloudy and cool. (Note: Aerial photos were taken <br /> by the DRMS on 19-Nov-2008.) <br /> Availability of Records <br /> Records were available for viewing at the nearby Landfill office. A completed DRMS Availability <br /> of Records checklist is attached. <br /> The reclamation bond will expire on 21-Jan-2009. <br /> The on-site copy of the Insurance Certificate expired on 01-Jun-2008, and needs to be replaced <br /> with a copy of the current Certificate. <br /> Signs and Markers <br /> A Mine Identification Sign was posted at the entrance to the mine permit area. <br /> Roads <br /> Roads and soils were dry, and all areas of the permit were accessible by vehicle. <br /> Hydrologic Balance <br /> The culvert pipe carrying the drainage beneath the road to Mine Area 3 was clear at both the <br /> inlet (Figure 1) and outlet, and the upstream and downstream ground surfaces are well <br /> vegetated. <br /> The three culvert pipes at the turnoff from the main road to Mine Area 3 were also clear. <br /> Pond A was completely dry (Figure 2). Temporary diversion ditches to the pond appeared to be <br /> clear and adequately bermed. <br /> The water retained in Pond B had diminished to a muddy puddle (Figure 3). Discharge inlet <br /> (Figure 4) and emergency spillway were clear. <br /> Toosoil <br /> The eastern and western topsoil stockpiles south of the road to Mine Area 3 were both fenced <br /> and signed, and appeared to be stable (Figure 5). <br /> Fish & Wildlife <br /> The mud at Pond B was heavily crisscrossed with tracks of deer and elk (Figure 6). Although the <br /> water quality is extremely poor, it continues to attract thirsty wildlife. <br /> Revecietation <br /> Reclaimed Mine Area 3 was securely fenced, preventing access by cattle. <br /> Reclamation Success <br /> Various features of the permit area are delineated on the aerial photo in Figure 7.
