Decision Date Extension to Amend Application into a 110d, Designated Mining Operation.
Dear Mr. Carter:
The Division of Reclamation Mining and Safety has received Nuvemco's request to extend the decision date
from December 15, 2008 to April 15, 2009 for the above referenced 110(2) application. The reason for the
request is to allow Nuvemco additional time to gather required information to amend the application into a
110d. The amendment is required due to changes in the law which went into affect on May 20, 2008 per House
Bill 1161. Nuvemco has until April 15, 2009 to submit the amended application. If the amended application is
not received by that date staff will have no choice but to deny the application as it will have exceeded 365 days
per Rule 1.4.1(9). The extension request is noted and accepted.
