As you know, our office represents Lafarge West, Inc. ("Lafarge") concerning the gravel
extraction operations on and near your property. We are in receipt of a document from you dated
November 5, 2008 and :entitled ".Demand. for. Compliance,of License Agreement",("Demand").
At the outset,! please; note that% your notice was . not _ provided in accordance with the notice
provisions of the License. Agreement dated January 31, 2008.("Agreement"). Therefore, we ate
not treating it as a proper notice under the Agreement for purposes of triggering any right to cure
deadline. Nevertheless, this letter will respond to the points raised in your Demand in the order
presented.
1. "The tenants have failed to complete the reclamation of the previous gravel pit located
on the Snyder's property."
RESPONSE: As outlined in the recitals of the Agreement, reclamation on dio Premises
is ongoing and will be completed in accordance "ith the applicable state and local permits. The
Agreement imposes no additional deadlines and, as such, there is no breach.
2. "Item 713, The irrigation system"
RESPONSE: As you are aware, the irrigation. system is in place, and all that remains is
for Lafarge to provide you= with a bill. of sale for the personal property connected to the system.
A contractor apparently crushed a small section. of .pipe, which will be repaired swithin.the next
30 days or sooner. Lafarge will provide the,. bill of sale within 30 days of the date of this. letter.
