DEPARTMENT OF NATURAL RESOURCES
DIVISION OF WATER RESOURCES
Bill Ritter, Jr.
Governor
Harris D. Sherman
Executive Director
Dick Wolfe, P.E.
Director
Response to Reclamation Permit Application Consideration
DATE: December 17, 2008
TO: v ichael A. Cunningham, Environmental Protection Specialist
CC: Division 1 Office, District 3 Water Commissioner
FROM: loana Comaniciu, P.E.
RE: Journey Ventures Pit, File No. M-2008-080 v -;-
Operator: Chris-Leone, Journey Ventures, LLC, (970)-392-0694°C
Contact: J.C. York, J. T. Consulting, Inc., (303)-457-0735 Division 01
Sec 7, Twp. 5 North, Rng. 64 West, 6th P.M., Weld County K4M-inoznd 7, -
CONDITIONS FOR APPROVAL
? The proposed operation does not anticipate exposing groundwater. Therefore, exposure of ground
water must not occur during or after mining operations.
® The proposed operation will still consume ground water by: ® evaporation, ® dust control,
reclamation, ® water removed in the mined product, ® processing, ® other: dewatering.
Prior to initiation of these uses of ground water, the applicant will need to obtain either a gravel pit or
other type of well permit, as applicable. However, prior to obtaining a permit, an approved water supply
plan or decreed plan for augmentation is required. Our records show that a well permit application and
associated temporary substitute water supply plan have not been submitted to the State Engineer's
Office.
® Prior to approving a well permit, the applicant must conduct a field inspection of the site and document
the locations of all wells within 600 feet of the permit area. The applicant must then obtain a waiver of
objection from all well owners with wells within 600 feet of the permit area or request a hearing before
the State Engineer.
® The proposed operation may have potential impact on existing water rights near the project location.
Applicant needs to demonstrate that the proposed project will not alter or impact the historic operation of
existing water rights.
® The applicant indicated that the water from the dewatering trenches will be pumped to a collection pond
from which the water will be pumped into an irrigation lateral and eventually discharge into the South
Platte River. In order to ensure that water from the dewatering trenches is not being used for irrigation
the applicant shall demonstrate that the water pumped in the irrigation lateral is done with the ditch
company approval and the water will be discharge into the South Platter River with no delay impacts.
COMMENTS: If stormwater runoff is intercepted by this operation and is not diverted or captured in priority, it
must be released to the stream system within 72 hours. This may require a discharge permit from CDPHE-
WQCD. Otherwise, the operator will need to make replacements for evaporation.
Office of the State Engineer A-
1313 1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303-866-3581 • Fax: 303-866-3589
www.water.state.co.us
