APR-15-2008 03:59PM FROM-DIV RECLAMATION MINING & SAFETY +3038328106 T-592 P.001/001 F-744 <br />San Luis Peoples Ditch <br />San Luis, CO <br />April 1, 2008 <br />Ronald Cattany <br />Colorado Department of Reclamation, Mining and Safety <br />1313 Sherman Street, Suite 215 <br />Denver, CO 80203 <br />Dear Mr. Cattany, <br />The San Luis People's Ditch is adamantly opposed to the proposed Permit Amendment, <br />DRMS Permit No. M-88112, filed by Battle Mountain Gold on October 2006. Not only <br />will this permit, if allowed, potentially allow contaminated water for agricultural <br />irrigation, it will also provide for use of water for new farm ground and the addition of <br />new water rights. <br />In addition, the proposal to close the water treatment facility at Battle Mountain Gold is <br />short-sighted. It is our contention that this violates the original permit which stated the <br />water would be as clean or cleaner than prior to the beginning of the mine's operation. <br />The entire community is concerned about the quality of its ground and underground <br />water. Needless to say, there is a school down stream of the water treatment centcr. <br />Futhermore, it is our belief that the Division of Reclamation, Mining and Safety has over <br />stepped its boundary and it does not have the right to change water usage, that is the sole <br />responsibility of the Division of Water Resources. <br />In summary, we are opposed to the application of Battle Mountain Gold. <br />Sincerely, <br />AV <br />Conrad Trujillo, President <br />San Luis Peoples Ditch <br />RECEIVED <br />APR 14 2008 <br />Division ut neaamation, <br />Mining and Safety
