APR-15-2008 03:59PM FROM-DIV RECLAMATION MINING & SAFETY +3038328106 T-592 P.001/001 F-744
San Luis Peoples Ditch
San Luis, CO
April 1, 2008
Ronald Cattany
Colorado Department of Reclamation, Mining and Safety
1313 Sherman Street, Suite 215
Denver, CO 80203
Dear Mr. Cattany,
The San Luis People's Ditch is adamantly opposed to the proposed Permit Amendment,
DRMS Permit No. M-88112, filed by Battle Mountain Gold on October 2006. Not only
will this permit, if allowed, potentially allow contaminated water for agricultural
irrigation, it will also provide for use of water for new farm ground and the addition of
new water rights.
In addition, the proposal to close the water treatment facility at Battle Mountain Gold is
short-sighted. It is our contention that this violates the original permit which stated the
water would be as clean or cleaner than prior to the beginning of the mine's operation.
The entire community is concerned about the quality of its ground and underground
water. Needless to say, there is a school down stream of the water treatment centcr.
Futhermore, it is our belief that the Division of Reclamation, Mining and Safety has over
stepped its boundary and it does not have the right to change water usage, that is the sole
responsibility of the Division of Water Resources.
In summary, we are opposed to the application of Battle Mountain Gold.
Sincerely,
AV
Conrad Trujillo, President
San Luis Peoples Ditch
RECEIVED
APR 14 2008
Division ut neaamation,
Mining and Safety
