Mike Boulay -2- December 18, 2008 <br />Items 11 through 14. Resolved <br />15. DRMS - The Division does not concur with sealing the four monitoring wells at the <br />Unit Train Loadout at this time, as proposed by SCC in Item 15 and on revised page 18- <br />5. In accordance with 4.05.13(3)(b) and based on a demonstration that the operation <br />has minimized disturbance to the hydrologic balance, the operator may request <br />reduction or deletion of the monitoring program or control system. These wells should <br />remain in place until a final bond release application is submitted and evaluated for the <br />UTL. As part of the Phase III bond release application the Division will need SCC to <br />provide a surface water and groundwater quantity and quality impact analysis. The <br />Division will make Findings regarding groundwater impacts during the bond release <br />inspection and evaluation process. If appropriate following the bond release evaluation <br />but prior to release of bond monies the wells may be sealed. <br />Likewise and for the same reasons stated above, the Division does not agree with <br />discontinuing monitoring and sealing of Rollins-2 upon approval of Permit Revision No. 4 <br />as stated on page 18-6. Please revise pages 18-5 and 18-6 accordingly to remove <br />the reference to discontinuing and sealing of UTL-01, 02, 03, 04 and Rollins-2 on <br />pages 18-5 and 18-6, respectively. <br />SCC: SCC agrees to leave the UTL and Rollins-2 monitoring wells intact and to <br />continue monitoring as per the approved schedule. Please withdraw revised permit <br />pages 18-5 and 18-6, revision date 02-08, from this submittal. <br />Item 16.
