Cattany <br />Division Director <br />Natural Resource Trustee <br />RE: Trapper Mining, Inc., Permit C-80-001, Permit Revision No. 6, Incomplete Application <br />Dear Mr. Luke, <br />On November 5, 2007, the Colorado Division of Reclamation, Mining and Safety (Division) received <br />from Trapper Mining, Inc. (TMI) an application for Permit Revision PR-06 for the Trapper Mine. Per <br />Division letter dated November 19, 2007, the Division found the application Incomplete. On February <br />5, 2008, TMI submitted its responses to the November 19, 2007 Division letter. The Division found <br />TMI's responses incomplete per Division letter dated February 15, 2008. On December 10, 2008 TMI <br />submitted its responses to the February 15, 2008 Division letter. The Division has reviewed these <br />responses, and in accordance with the requirements of Rule 2.08.4(5) finds that the application remains <br />Incomplete as of December 19, 2008, for the reasons described herein. <br />The Division's review of the TMI responses submitted December 10, 2008 concerning items deemed <br />Incomplete by the Division on February 15, 2008 is provided below. This is followed by additional <br />items required by the Board's Regulations that are needed to find the application Complete. <br />Division's initial comments No. 1 and No. 2: On pages 3-15a and 3-40, there are brief references to <br />the Horse Fill. Rules 2.05.3(6) and 4.09 pertain to excess spoil fills. Please provide design details as <br />required by Rules 2.05.3(6) and 4.09. Map M12 shows post-mining contours for the Buttress fill in <br />addition to the Horse fill. No technical design, cross-sections, or discussion in the text was found <br />regarding the Buttress fill. Pleas provide information regarding the Buttress fill in accordance with <br />Rules 2.05.3(6) and 4.09. <br />Trapper Mining Inc. 's initial response: It is Trapper's intention to fully comply with requirements <br />under Rule 2.05.3(6) and 4.09. A geotechnical investigation has not yet been performed; however this <br />work is planned for 2008. In the absence of this formal analysis and as an interim submittal, Trapper <br />has included, for your review, the following information regarding the proposed configuration of the <br />fills. <br />• Horse Gulch Fill - Plan View <br />• Horse Gulch Fill - Cross Sections (10) <br />Office of Office of <br />Mined Land Reclamation Denver 9 Grand Junction 9 Durango Active and Inactive Mines
