or gas storage facilities, municipal water-storage facilities, fluid-transmission pipelines, <br />gas or oil collection lines, or water or sewage lines (4.08.4(7)). <br />D. The Division is not proposing to approve the use of a modified equation to determine <br />maximum weight of explosives per delay (4.08.6(2)). <br />VII. Disposal of Excess Spoil <br />This section does not apply to the Bowie No. 2 Mine permit application. All excess material <br />generated during surface construction or during underground mining is considered to be coal <br />mine waste, and such materials will be placed in the approved coal mine waste bank. <br />VIII. Coal Mine Waste Banks <br />A. The Division approved plans for use, construction and maintenance of a coal mine waste <br />disposal area (4.10.1(1)). <br />B. The applicant has not submitted a plan for disposal, at the approved disposal area within <br />the permit boundary, of mine waste materials generated by activities outside the permit <br />boundary (4.10.1(2)). <br />C. The disposal area will be inspected on a regular basis by a qualified professional <br />engineer, experienced in construction of similar earth and waste structures (4.10.2(1)). <br />D. An alternative subdrainage system for the coal mine waste area has not been proposed. <br />The Division finds that the approved subdrainage system should ensure the applicable <br />static safety factor, stability of the fill, and protection of the surface and ground waters <br />(4.10.3(5)). <br />E. The Division is not proposing to approve a variation in the requirements for maximum <br />allowable lift thickness and minimum required compaction (4.10.4(3)(a)). <br />IX. Coal Mine Waste <br />A. Non-coal waste will be stored at designated locations at the mine site, then transported to <br />the Delta County landfill for proper disposal. <br />X. Backfilling and Grading <br />A. BRL will reclaim the mine site to achieve approximate original contour. All highwalls <br />will be eliminated during reclamation. BRL has not requested any variances regarding <br />backfilling and grading, nor are any approved with this decision document. <br />XI. Revegetation <br />Information regarding baseline vegetation studies may be found in Section 2.04. 10 of the permit. <br />Information regarding revegetation of disturbed areas may be found in Section 2.05.4 of the <br />permit. The goal of revegetation efforts at the Bowie No. 2 Mine is to reestablish a post-mining <br />land use of rangeland and wildlife habitat. Disturbed areas will be seeded with one of two seed <br />mixes, and straw mulch will be applied at a rate of 4000 pounds per acre. <br />32
