Cattany <br />Division Director <br />Natural Resource Trustee <br />Listed below are adequacy review comments for the Angie Pit 112 (c) Permit Amendment Application (AM-02), File <br />No. M-2000-049. The decision date for this permit application is June 4, 2008. The Division of Reclamation, Mining, <br />and Safety (Division) is required to make a decision by June 4, 2008. Therefore, your response to the following <br />adequacy review concerns should be submitted to the Division as soon as possible. <br />1. The status of Louisiana Land and Gravel Company is delinquent with the Colorado Secretary of State's <br />Office. The status of the company will need to be rectified prior to approval of the permit amendment. <br />Additionally, if this is not resolved, the operator may be found in violation of the permit. Please supply <br />documentation that the status of the company has been updated with the Secretary of State's Office. <br />2. As required by Rule 1.6.5 (2), please submit the proof of publication of the public notice circulated in the <br />local newspaper and all owners of record of surface lands, and easement holders that are on the affected land <br />and within 200 feet of the boundary of the affected land. Proof of notice may be return receipts of a Certified <br />Mailing or by proof of personal service. <br />Rule 6.4.4 Exhibit D - Minim Plan <br />3. The first line in the submitted exhibit states, "This is a new application for a sand and gravel operation located in <br />Montrose County." Please clarify that this is an application for an amendment. <br />4. Section 3.1.6(1) of the Mining Plan requires the Operator to minimize disturbance to the surface and groundwater <br />systems. The submitted Mining Plan states that all hazardous materials/petroleum products will be stored in a <br />storage cabinet that serves as primary containment for any spills. It is specified that this cabinet will be stored <br />within a trailer. Please specify whether the trailer is adequately constructed to serve as secondary containment, to <br />include raised thresholds at the entrance(s), or what secondary containment will be used in conjunction with <br />storage of these materials. This section also indicates that a 350 gallon fuel tank will be kept near the equipment <br />which uses the fuel for operation. Please identify the spill containment features that will be used in conjunction <br />with this fuel tank.
