Ill. COMMENTS- COMPLIANCE <br /> Seneca II C-1980-005 <br /> Pg 1/2 10 December 2008 <br /> Below are comments on the inspection. The comments include discussion of observations <br /> made during the inspection. Comments also describe any enforcement actions taken during <br /> the inspection and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection of the Seneca II Mine conducted by Jim Stark of CDRMS. Dennis Jones <br /> of SCC accompanied me on the inspection. The mine has been reclaimed and has undergone <br /> various stages of phased bond release, including a pending partial Phase II Bond Release for almost <br /> 1,800 acres. The weather was cold and overcast and the ground was covered with several inches <br /> (and more) of snow. Many of the mine areas were inaccessible due to the snow. <br /> Signs and Markers: The mine ID sign was up at the main gate to the mine (by the facilities area). <br /> The sign contained all of the necessary information. <br /> Roads: Road E1 was covered with packed snow at the time of the inspection. The road appeared to <br /> be stable and well maintained. The road became impassable at the location above where Pond 004 is <br /> located. <br /> - The lower road to Ponds 004 and 008 was impassable at the time of the inspection due to snow. <br /> Hydrologic Balance: Pond 002 was full and discharging at the time of the inspection. The discharge <br /> appeared to be clear. This is an incised pond and the inslopes were covered with some snow but <br /> appeared to be stable at the time of the inspection. No erosional problems were noted on the inslopes <br /> at the time of the inspection. <br /> - Pond 003 (the Shop pond)was full and was discharging a small amount at the time of the inspection. <br /> The pond embankment was covered with some snow but appeared to be stable. No erosional <br /> problems were noted on the pond embankment at the time of the inspection. <br /> - The Pecoco Pond was full and discharging at the time of the inspection. The discharge appeared to <br /> be clear. The pond embankment was covered with some snow but it appeared to be well vegetated <br /> and stable at the time of the inspection. There were no erosional problems noted on the pond <br /> embankment at the time of the inspection. <br /> - Pond 004 was observed from above (from Road E1). The pond contained water but it was not clear <br /> whether the pond was discharging at the time of the inspection. The pond embankment was covered <br /> with snow but appeared to be stable. No erosional problems were noted on the pond embankment at <br /> the time of the inspection. <br /> - Pond 008 was inaccessible at the time of the inspection. <br /> -The ditch around the south and west sides of the facilities area has been cleaned. The ditch <br /> appeared to be stable and no erosional problems were noted on the inslopes of the ditch at the time of <br /> the inspection. A small amount of water was flowing in the ditch and the ditch appeared to be <br /> functioning properly. <br /> Backfilling and Grading: The regraded prelaw spoil areas were viewed from Road EL The area was <br /> covered with snow but it appeared to remain stable. <br /> -The regraded slopes along Road E1 appeared to remain stable at the time of the inspection. No <br /> slides or erosional problems were noted. <br /> Support Facilities: The facilities area was covered with snow at the time of the inspection. The pad <br /> area appeared to be well graded and stable with no erosional problems noted. There are some <br /> pieces of old equipment at the warehouse/shop area. <br /> -The operator has placed more topsoil on the area of the old solid waste disposal area. The area <br /> appears to remain stable. <br />
