response to Adequacy Item No. 4, of the Division's July 11, 2007 Preliminary Adequacy Review <br />letter for Permit Renewal No. 5 (RN-05). The revision application provided "as-built" reclamation <br />contours, cross-sections, and details pertinent to the reclamation grading completed in 2007, along <br />with narrative updates addressing any modifications to the approved plan and explanation of the <br />reasons for the modifications. <br />Minor Revisions <br />MR-24 approval decision was issued October 31, 2005. The revision provided documentation <br />regarding the adequacy of temporary coal waste disposal area ditch dimensions, in response to concerns <br />identified by the Division during the mid-term permit review. The mid-term calculation of the "worst <br />case" reclamation liability ($226,349) was also confirmed by the MR-24 approval. <br />MR-25 approval decision was issued December 2, 2005. The revision allowed for construction of a <br />light use road through the Munger Canyon Mine permit area to the McClane Canyon Mine permit area <br />boundary, to access an emergency drill site required by order of the Mine Safety and Health <br />Administration (MSHA). The drilling was for the purpose of monitoring conditions inside the <br />McClane Canyon Mine workings following an explosion at that mine. A short segment of the light use <br />road crossed an area that was not included within either the Munger Canyon Mine permit area or the <br />McClane Canyon Mine permit area. Stipulation No. 33, attached to the approval decision, required <br />submittal of an incidental permit boundary revision application by December 30, 2005, to incorporate <br />the light use road segment into the Munger Canyon Mine permit area. The permit boundary revision <br />was included in TR-20, which satisfied and allowed for termination of Stipulation No. 33. <br />MR-26 approval decision was issued January 19, 2006. The revision incorporated an official permittee <br />name change into the permit application. Central Appalachia Mining LLC changed its name to CAM <br />Mining LLC. <br />MR-27 approval decision was issued February 16, 2006. The revision incorporated a noxious weed <br />control plan into the approved permit. <br />MR-28 approval decision was issued August 22, 2006. The revision updated Permit Appendix "A" to <br />reflect the new resident agent and inspection contact, Gary Isaac. <br />MR-29 approval decision was issued September 21, 2006. The revision incorporated 27 new permit <br />map figures into the permit application package, to reflect the revised permit boundary approved in TR- <br />20. Appendix "G" Adjacent Property Owner listings were updated to reflect ownership changes, and <br />Appendix "L" was updated to include a letter from Grand Valley Rural Power Lines, Inc. (GVP), <br />verifying that GVP owned power poles located on the mine property had been modified to comply with <br />USFWS avian protection guidelines. <br />MR-30 approval decision was issued October 31, 2006. The revision authorized an extension of the <br />permit deadline for sealing Alluvial Monitoring Wells #2, #4, #7, and #8, from 2006 to 2007. The <br />wells were sealed during the 2007 field season, and an abandonment report documenting proper sealing <br />in accordance with Rule 4.07.3(3) was submitted under cover letter dated September 13, 2007 (see
