Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, <br />Section 118, Paragraph 3, of the Colorado Revised Statutes, that on May 11, 2007, an application to renew an <br />existing permit to conduct coal mining operations at the Munger Canyon Mine was considered complete for the <br />purposes of filing. All review and comment periods as provided in the Colorado Surface Mining Reclamation Act <br />and the Rules initiate from this date of filing. <br />CAM Mining LLC proposes to continue Underground coal mining and/or reclamation operations on land located <br />approximately 18 miles North of Loma, Colorado. The permit area is further described as follows: <br />Mine site: Portions of Sections 27, 28, and 29, T7S, R102W, 6th P.M., all in Garfield County. <br />Rail Loadout: Portions of Section 34, T2N, R3W, Ute PM, in Mesa County. <br />Portions of Section 3, TIN, R3W, Ute PM, in Mesa County. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Howard Canyon & Garvey <br />Canyon (Mine Area) and Mack (Loadout Area). <br />This application would allow for renewal of a valid existing permit for the Munger Canyon Mine and Loma <br />Loadout, Coal Mining and Reclamation Permit No. C-1981-020. <br />No additional surface disturbance is proposed as a result of this renewal application, and no threatened, <br />endangered, or candidate species have been added to the list for Garfield or Mesa County since the USFWS most <br />recent formal consultation for Munger Canyon Mine (see June 16, 2006 memorandum from Allen R. Pfister, <br />USFWS, to Carl Johnston, OSM). As a result, the Division does not anticipate additional impacts to wildlife, and <br />we do not anticipate that a new biological assessment will be warranted.
