<br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 118,
<br />Paragraph 3, of the Colorado Revised Statutes, that on May 11, 2007, an application to renew an existing permit to conduct coal
<br />mining operations at the Munger Canyon Mine was considered complete for the purposes of filing. All review and comment
<br />periods as provided in the Colorado Surface Mining Reclamation Act and the Rules initiate from this date of filing.
<br />CAM Mining, LLC proposes to continue Underground coal mining and/or reclamation operations on land located
<br />approximately 18 miles North of Loma, Colorado. The permit area is further described as follows:
<br />Mine site: Portions of Sections 27, 28, and 29, T7S, R102W, 6th P.M., all in Garfield County.
<br />Rail Loadout: Portions of Section 34, T2N, R3W, Ute PM, in Mesa County.
<br />Portions of Section 3, TIN, R3W, Ute PM, in Mesa County.
<br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Howard Canyon & Garvey Canyon
<br />(Mine Area) and Mack (Loadout Area).
<br />This application would allow for renewal of a valid existing permit for the Munger Canyon Mine and Loma Loadout, Coal
<br />Mining and Reclamation Permit No. C-1981-020. The renewal application does not propose additional surface
<br />disturbance or substantive changes in the operations or reclamation plans.
<br />The section of the permit that addresses threatened and endangered species of plants and animals is outdated. However, a draft
<br />biological assessment was prepared for the Munger Canyon Mine site and the neighboring McClane Canyon Mine (Permit No.
<br />C-1980-004) by Rare Earth Science, LLC, in March 2006. Both permits are operated by CAM Mining LLC. The report was
<br />incorporated into the McClane Mine permit as Table 4.3-9, and we will require that the company update the appropriate
<br />sections of the Munger Canyon permit and incorporate the draft biological assessment report into the Munger permit as well, in
<br />association with this permit renewal. A copy of the report is enclosed.
<br />The report covers the mine site portion of the permit area, which is in Garfield County, and addresses potential impacts to all
<br />currently listed Endangered (E), Threatened (T), and Candidate (C) species as follows:
<br />Bald Eagle (T), Bonytail (E), Canada Lynx (T), Colorado Pikeminnow (E), Debeque Phacelia (C),
<br />Humpback Chub (E), Mexican Spotted Owl (T), Parachute beardtongue (C), Razorback Sucker (E), Uinta
<br />Basin Hookless Cactus (T), and Yellow Billed Cuckoo (C).
