The following specific findings apply to the existing access road constructed in 1977:
The applicant has provided a relevant showing in lieu of certification, demonstrating
that the road meets the performance standards of Rule 4.03.2. (4.03.2(1)(f)(ii))
2. The short lower segment of the access road east of the 2004 re-aligned haul road
segment, on the Munger Canyon Valley floor, will not be reclaimed in accordance
with Rule 4.03.2(7)(a)(i) through (ix), but will be modified for use postmining, in
accordance with surface landowner (BLM) request. The Division approves the
retention of the lower road segment as it will accommodate the postmining land use
(rangeland), the modified road will comply with all applicable performance
standards, and the landowner (BLM) has made a written request that the road be
retained for further use (4.03.2(1)(g)).
C. Light-Use Roads
During November and December 2005, a temporary light use road was constructed along the
north fork of Munger Creek, extending from the Munger Canyon Mine access road to the
McClane Canyon Mine permit boundary. The purpose of the road was to provide access to
an emergency drill site located inside the McClane Canyon Mine permit area (to monitor
atmosphere in the McClane mine workings after an explosion). The road was used for only a
short time in the winter of 2005/2006, and subsequently reclaimed in the spring of 2006. The
road was constructed and reclaimed in accordance with applicable requirements of Rule
4.03.3. See Section 2.2.2.2 of the permit application.
With the acceptance of Stipulation No. 32, the proposed operation is in compliance with the
requirements of this section.
II. Support Facilities- Rule 4.04
The coal loadout facility is located approximately 21 miles from the mine site along the
D&RGW Railroad siding near Loma, Colorado. Approximately 2.9 acres of disturbance is
associated with the facility. The site was previously used as a storage and loading site for
sugar beets. Structures at the site were removed and coal material cleaned up and hauled off
in 2001. Initial permanent stabilization seeding was done in 2001. Remedial seeding with a
modified seedmix was conducted in the fall of 2004, due to failure of the initial seeding.
The proposed operation is in compliance with the requirements of this section.
III. Hydrologic Balance- Rule 4.05
A. Water Quality Standards and Effluent Limitations
21
