III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection of the McClane Canyon Mine conducted by Mike Boulay of the Division <br /> of Reclamation, Mining and Safety on December 4, 2008. There was no operator/representative from <br /> McClane Canyon Mine present during the inspection. Weather conditions were sunny and cool. <br /> Ground conditions were mostly dry. Coal was being conveyed from the mine at the time of inspection. <br /> Coal was being hauled from the mine and trucks were observed being loaded with coal during the <br /> inspection. <br /> Roads <br /> The access road to the temporary coal waste pile was wet and muddy with some ruts. The road surface <br /> around the portals area was also wet and muddy. All other mine site roads were well maintained. <br /> Ditches were clear of sediment and debris and appeared functional. <br /> Hydrologic Balance <br /> Drainage structures and diversion culverts in the portal area were dry and clear of debris. The <br /> sediment pond was containing muddy water at a level approximately five feet below the principal <br /> spillway. The surface of the pond was partially frozen. The pond was recently cleaned out and is well <br /> maintained. There was no mine water discharge at the time of inspection. <br /> Processing Waste <br /> The temporary coal waste pile area located above the sediment was inspected. The clean water <br /> diversion ditch around the waste pile and sediment storage area is maintained and in good condition. <br /> The berm surrounding the waste pile is in good condition and functional. No problems were noted at <br /> any of the mine site locations during this inspection. <br />
