mine site, and WQCD could assume regulation over the pipeline and land application <br />discharge on the adjacent Salazar Ranch. <br />At this point the Division is requesting a position statement from CDPHE regarding the <br />jurisdictional position of WQCD and HMWMD/Solid Waste regarding the future <br />regulatory oversight of the Battle Mountain site. We would like to make this <br />jurisdictional position public so that the objectors and other interested parities are aware <br />of which state agency will have future regulatory authority. We also believe it is <br />important that the Division issue something to the public to indicate that this <br />jurisdictional matter has been discussed and resolved through a cooperative effort of all <br />state agencies involved. <br />Battle Mountain is a unique situation in that it involves an unusually large number of <br />objectors. The Division is going to commit itself to a series of public meetings, in the <br />form of informal conferences and pre-hearing conferences, in an effort to inform the <br />public of the process and the role of the Division, and to answer questions of concern to <br />the objectors. There is little doubt that the public will ask questions about future <br />regulation of the site and the Division wants to be in a position to answer such questions. <br />To respond fully to these questions, the Division hereby formally requests that WQCD <br />provide a representative at the informal meeting and at the formal public hearing before <br />the Mined Land Reclamation Board. The tentative dates for these meetings are April 15`h <br />for the informational meeting and June 11`h and 12`h for the formal board hearing. Once <br />the dates, times and locations are firmed up we will contact you with that information. <br />All of these meetings will take place in or near the Town of San Luis. <br />Thank you in advance for your consideration and assistance in this matter and we look <br />forward to your response.
