mine site, and WQCD could assume regulation over the pipeline and land application
discharge on the adjacent Salazar Ranch.
At this point the Division is requesting a position statement from CDPHE regarding the
jurisdictional position of WQCD and HMWMD/Solid Waste regarding the future
regulatory oversight of the Battle Mountain site. We would like to make this
jurisdictional position public so that the objectors and other interested parities are aware
of which state agency will have future regulatory authority. We also believe it is
important that the Division issue something to the public to indicate that this
jurisdictional matter has been discussed and resolved through a cooperative effort of all
state agencies involved.
Battle Mountain is a unique situation in that it involves an unusually large number of
objectors. The Division is going to commit itself to a series of public meetings, in the
form of informal conferences and pre-hearing conferences, in an effort to inform the
public of the process and the role of the Division, and to answer questions of concern to
the objectors. There is little doubt that the public will ask questions about future
regulation of the site and the Division wants to be in a position to answer such questions.
To respond fully to these questions, the Division hereby formally requests that WQCD
provide a representative at the informal meeting and at the formal public hearing before
the Mined Land Reclamation Board. The tentative dates for these meetings are April 15`h
for the informational meeting and June 11`h and 12`h for the formal board hearing. Once
the dates, times and locations are firmed up we will contact you with that information.
All of these meetings will take place in or near the Town of San Luis.
Thank you in advance for your consideration and assistance in this matter and we look
forward to your response. If you have any questions please feel free to call me at 303-
866-4926.
l*e el
Anthony J. Waldron
Senior Environmental Specialist
Cc: David A.
