Carbon Junction Mine. p. 22 <br /> The North Pit access road is approved for retention and does not have any serious erosion <br /> problems. <br /> We continued inspecting the approximately 30 acres described above and made stops and <br /> observations at the following: topsoil stockpile# 2, Carbon Junction channel which is stable, <br /> up -gradient water monitoring well B-17-1 needs to be reclaimed, sediment pond# 2 is stable <br /> and the permittee had made the necessary sedimentology demonstration to reclaim the sediment <br /> ponds throughout the site (the permittee has applied for termination of the NPDES permit <br /> applicable to these sediment pond outfalls), and the main, paved, entrance road had been <br /> approved for retention as had one light use (unpaved) access road. <br /> The South Pit reclaimed drill site is stable, and the temporary diversion east of the equipment <br /> storage area will be reclaimed in association with sediment pond #1 (as well as any other <br /> temporary diversions to pond# 1, or any temporary diversions that have not been approved for <br /> permanent retention). The topsoil stockpiles adjacent to sediment pond 41 will be used to reclaim <br /> this fully incised pond. Pond#1 is stable and no problems were noted around the pond# 1 area, <br /> or the topsoil stockpiles. <br /> All old mining equipment and bone yard debris has been removed as required from the former <br /> equipment area. This concluded the field inspection. <br /> We held a close out meeting on site and briefly discussed the following: <br /> Alternative post-mining land uses of residential, recreation, and industrial-commercial were <br /> approved by DMG in 1996. Only the residential alternative post-mining land use applies to the <br /> approximately 30 acres in SL-4. <br /> In 2007,the permittee (also the landowner in this case, Oakridge Energy, Inc.) subdivided <br /> acreage on Ewing Mesa(including the permit area) into 35 acre parcels and recorded these <br /> 35 acre parcels at the La Plata County Clerk&Recorders Office in Durango, CO.No La Plata <br /> County approvals are necessary to record the 35 acre parcels for residential use at the County <br /> Clerk &Recorders office. This property subdivision for residential development is allowed by <br /> Colorado State law. The approved 35 acre parcels are for residential use. This was discussed by <br /> us on site, and in e-mail correspondence provided to Mr. Kaldenbach and me by Mr. Savage on <br /> October 31,2008.There have been no public or governmental comments provided regarding SL- <br /> 4 through the required notifications and Public Notice process. There were no offsite impacts <br /> documented during the inspection. Established ground cover appears to be sufficient to control <br /> erosion. The State NPDES authority has been contacted by the permittee requesting cancellation <br /> of the NPDES permit. The permittee intend to reclaim the sediment ponds (NPDES outfalls <br /> including the discharge structures from the sediment ponds) and temporary diversions to the <br /> ponds. <br /> This concluded the inspection.
