III. COMMENTS- COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
This was a partial coal inspection conducted by Jason Musick of the Colorado Division of
Reclamation, Mining, and Safety(Division)on 04 December 2008. The weather was cloudy and the
mine site was wet during the on-the-ground inspection of the site. Jim Jarvis of GCC Energy
accompanied the on-the-ground inspection.
Work was being conducted on the drainages above and to the east of the coal waste pile at King I at
the time of the inspection
Roads
The mine entrance road at The King I site was well maintained with no problems noted at the time of
the inspection.
Hydrologic Balance
The east and west sediment ponds at the King I site have recently had sediment removed. Both
ponds contained a small amount of water at the time of the inspection. No discharge was noted at the
time of the inspection. The primary and secondary spillways of the east and west ponds appeared to
be in compliance with no problems noted. The pond embankments were stable with no evidence of
erosion or damage. The King II sediment pond was dry at the time of the inspection with no problems
noted.
Ditches in and around the King I site were stable with no problems noted. All inlet and outlets of
culverts and drains were clear of debris at the time of the inspection.
No problems were noted with the sediment catchments at the mine entrance during the inspection.
Processing Waste
At the time of the inspection, the operator was extending the refuse pile drainage. The eastern side of
the refuse pile has been excavated for the drain extension although no signs of instability or adverse
drainage conditions from the refuse pile were noted during the inspection.
Support Facilities
Facilities structures were in the process of being constructed at the time of the inspection. No
problems or compliance issues were noted.
