III. COMMENTS- COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety(Division)on 04 December 2008. The weather was cloudy and the <br /> mine site was wet during the on-the-ground inspection of the site. Jim Jarvis of GCC Energy <br /> accompanied the on-the-ground inspection. <br /> Work was being conducted on the drainages above and to the east of the coal waste pile at King I at <br /> the time of the inspection <br /> Roads <br /> The mine entrance road at The King I site was well maintained with no problems noted at the time of <br /> the inspection. <br /> Hydrologic Balance <br /> The east and west sediment ponds at the King I site have recently had sediment removed. Both <br /> ponds contained a small amount of water at the time of the inspection. No discharge was noted at the <br /> time of the inspection. The primary and secondary spillways of the east and west ponds appeared to <br /> be in compliance with no problems noted. The pond embankments were stable with no evidence of <br /> erosion or damage. The King II sediment pond was dry at the time of the inspection with no problems <br /> noted. <br /> Ditches in and around the King I site were stable with no problems noted. All inlet and outlets of <br /> culverts and drains were clear of debris at the time of the inspection. <br /> No problems were noted with the sediment catchments at the mine entrance during the inspection. <br /> Processing Waste <br /> At the time of the inspection, the operator was extending the refuse pile drainage. The eastern side of <br /> the refuse pile has been excavated for the drain extension although no signs of instability or adverse <br /> drainage conditions from the refuse pile were noted during the inspection. <br /> Support Facilities <br /> Facilities structures were in the process of being constructed at the time of the inspection. No <br /> problems or compliance issues were noted. <br />
