III. COMMENTS- COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial coal inspection of conducted by Jason Musick of the Colorado Division of, <br /> Reclamation, Mining, and Safety(Division)on 03 December 2008. Henry Barbe and Ryan <br /> Sweetwood of Mountain Coal Company accompanied the inspection. The weather was cloudy during <br /> the inspection. The ground was wet with a small amount of snow cover on the ground. <br /> The longwall was not active at the time of the inspection. <br /> Signs and Markers <br /> Mine I.D. signs were properly displayed at Highway 133. <br /> Roads <br /> All roads at the facility area were in dry and in good condition with no problems noted at the time of the <br /> inspection. The Sylvester Gulch road was dry to the road that leads to the Deer Creek shaft <br /> construction area. The Sylvester Gulch road was stable and in good condition with no problems noted <br /> at the time of the inspection. The upper section of the Sylvester Gulch road appeared to be recently <br /> maintained and was in good condition. Road ditches and culverts appeared to be in compliance with <br /> no problems noted. The access road leading from Sylvester Gulch to the Deer Creek shaft <br /> construction site and on to Monument Dam was well maintained with a small amount of snow cover <br /> downhill towards the dam. <br /> Processing Waste <br /> Grading and bulldozing work was being conducted on the refuse pile slopes at the time of the <br /> inspection. The Refuse Pile showed no evidence of structural instability or signs of erosion at the time <br /> of the inspection. <br /> Support Facilities <br /> No problems were noted in and around the main facilities area. Work was being conducted to enclose <br /> the facilities on top of the stacker tubes. There was a small amount of coal stock pile at the time of the <br /> inspection. No problems were noted at the following sites: Shaft#1 vent intake and air heating <br /> building, Shaft#2 exhaust area, Shaft#3 exhaust area, and the Sylvester Gulch substation. <br /> Construction continues at the Deer Creek Shaft site. The main shaft was -50 ft at the time of the <br /> inspection. No problems were noted in and around the Deer Creek shaft site. <br /> Off-Site Support Facilities <br /> The Monument Dam appeared to be complete. No problems were noted and the dam appeared to be <br /> stable with a substantial amount of water in the reservoir. <br />
