III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety(Division)on 04 December 2008. The weather was cloudy and the <br /> mine site was wet during the on-the-ground inspection of the site. The site is controlled by a entry <br /> gate that was unlocked at the time of the inspection. No activities were observed during the inspection <br /> of the site. <br /> Roads <br /> The asphalt main road was well maintained with no problems noted at the time of the inspection. The <br /> surface of the North Pit haul road was in good condition during the inspection with no problems noted. <br /> Hydrologic Balance <br /> Ponds 1 and 2 were dry at the time of the inspection. The two ponds were in good condition with no <br /> problems noted. The embankments of the ponds were stable with good vegetation establishment at <br /> the time of the inspection. No problems were noted at the discharge of Pond 1 or Pond 2. <br /> The Carbon Junction channel appeared to be functioning as permitted with no problems noted. There <br /> was a small amount of sediment in the culverts with no evidence of recent runoff. <br /> Topsoil <br /> Topsoil stockpiles 4 and 8 appeared stable with no evidence of erosion or damage. Piles were well- <br /> vegetated at the time of the inspection with no weed problems noted. <br />
