III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining <br /> and Safety. The mine is a reclaimed surface mine. The weather was cold, windy and snowing lightly. <br /> The Mine site and Load Out had received precipitation within the last day of as noted by damp areas, and <br /> patches fresh snow. <br /> Roads: The mine access road is wet and muddy. Recent tire tracks along the access road to the facilities <br /> area were apparent in the fresh snow. The access road was slick due to the high clay content. The <br /> inspector stopped on the roadway prior to reaching the drainage to Pond D. The vehicles that had <br /> accessed the mine site were no longer on the property during the inspection. <br /> The access road to the load out was in good condition. <br /> Hydrologic Balance: None of the ponds were discharging at the mine site or at the Load Out. Ponds <br /> were either dry or holding small pools of water well below the discharge elevations. Pond bottoms were <br /> snow covered and those holding pools of water were ice covered. No problems were identified with the <br /> ponds. <br /> Reclamation Success: The landowner has requested to keep SP-1 as a permanent well to use for <br /> livestock watering. KCC and the landowner have gone through the appropriate transfer process and have <br /> obtained a well permit through the Division of Water Resources. SP-1 will remain as a permanent well. <br /> The Division is awaiting Abandonment reports for the recently sealed monitoring wells. <br /> Offsite support facilities: There has been no new activity at the load out. The gate remains locked. No <br /> problems noted with the load out pond or with the reclaimed load out area. Pond is ice covered and well <br /> below the discharge elevation. <br /> 3 of 5 WHITE- File YELLOW-Operator PINK-Specialist <br />
