Notice of the proposed decision was published in the Durango Herald once a <br />week for two weeks beginning August 21, 2008. A request for a formal hearing was not <br />received; therefore, pursuant to Section 2.07.4 of the Regulations of the Colorado Mined <br />Land Reclamation Board for Coal Mining, the decision became final on September 22, <br />2008.
