III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was an aerial inspection of the McClane Canyon Mine conducted by Harry Ranney of the <br />Division of Reclamation, Mining and Safety (DRMS). Aerial photographs were taken on <br />November 19, 2008 at approximately 12:07 p.m. Seven photographs were taken during the <br />flyover. Weather conditions appeared to be clear and sunny at the time of the flight. Mike <br />Boulay of the DRMS reviewed the aerial photographs. <br />The majority of the mine site was visible in the photographs including the portal area, coal waste <br />storage location, sediment pond, and office location. The portal area and coal stockpile are <br />shown in attached Photo No. 1. The coal waste storage area and sediment pond are shown in <br />Photo No. 2. Coal was being conveyed from the mine at the time of the inspection. The only <br />other activity discernible in the photographs is at the coal stockpile where a loader was working. <br />A large section of the mine site haul road was visible in the photographs, and appeared well <br />maintained and in good condition. The portal area and upper section of the road were wet. <br />Ground conditions at the remainder of the site were dry. The sediment pond was retaining water <br />and appeared to be partially snow covered or frozen at the surface. <br />The portal facilities area is well maintained. The coal waste storage area is well maintained and <br />the berm surrounding the pile appeared to be in good condition. All site locations visible in the <br />photographs appeared stable and no significant erosion or other problems were identified with <br />this aerial inspection.
