Cattany <br />Division Director <br />PO BOX 758 Natural Resource Trustee <br />Greeley, CO 80632 <br />RE: Weld County, Permit No. M-1980-149 " <br />Hokestra Amendment Application 03 (AM-03)-Adequacy Review #2 <br />Dear Mr. Nelson, <br />The Division received the adequacy responses for the Hokestra Amendment Application 03 (AM-03), <br />File No. M-1980-149. The response was submitted by Applegate Group on behalf of Weld County. The <br />Division has remaining comments that need to be addressed by the Weld County; <br />1. As required by Rule 6.4.3(a) please provide a map portraying all adjoining surface owners of record. <br />2. Please provide a revised application form reflecting the actual permit acres (the current form noted <br />120 acres). It is the Division's understanding that with the approval of Acreage Reduction 04 (AR- <br />04) on October 9, 2007 that the permit area is currently 172 acres. <br />3. It is stated that the proposed slurry wall will cross several gas lines, and that Weld County has been <br />assured that this is a routine procedure. The operator will need to demonstrate that such gas/oil lines <br />will be stable with the construction of the proposed slurry wall in the form of an engineering <br />evaluation, or provide a notarized agreement from the owners of the structure(s) and Weld County <br />that meets the requirements of Rule 6.4.19 and Section 34-32.5-115(4)(e), C.R.S. Please be aware <br />that if any of the gas/oil lines need to be relocated as a result of the mining and reclamation <br />operation, then a notarized agreement between the operator and the owner of the structure must be <br />obtained prior to approval of the application. <br />4. Weld County proposes to construct a French drain around the perimeter of the site to offset any <br />potential impacts to the surrounding groundwater and that monitoring wells will continue to monitor <br />the groundwater levels. The operator states that a trigger point will be determined once a year's <br />worth of groundwater data has been collected. Weld County will need to commit to a trigger point <br />under this amendment application. Attached is a copy of the revision that the Division approved for <br />the adjacent pit operated by Carina Bayshore, Permit No. M-1982-015 regarding a trigger point plan. <br />5. In the response prepared by Applegate Group it is stated that very large spillways would be required <br />to allow the water level in the reservoirs to equalize with the river prior to the river overtopping the <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
