Objection to BMRI's AM-03 <br />Page 5 of 23 <br />February 22, 2008 <br />a) Permit No. 53737-F for 40 gpm; <br />b) Permit No. 53738-F for 20 gpm;. <br />c) Permit No. 52744-F for 50 gpm; <br />d) Permit No. 52745-F for 50 gpm; <br />e) Permit No. 52746-F for 50 gpm; <br />f) Permit No. 52747-F for 50 gpm; and <br />g) Permit No. 52748-F for 50 gpm. <br />As part of the.99CW057 decree, the.Court noted the.waters were delivered to the <br />water treatment facility, treated, and discharged into the Rito Sego pursuant to a <br />CDPHE permit, Permit No. CO-0045675 issued on December 8, 2000. (Decree, p. 7) <br />The decree further recognized that the discharge permit "[C]ontains a number of <br />limitations and conditions that are designed to assure that the operation of the treatment <br />plant and the quality of the waters discharged will protect the quality and uses of the <br />Rito Seco." (Decree, p. 7) <br />The 99CW057 Court recognized the previous decree 89CW32 when it noted: <br />The previous decree applied primarily to the period of <br />Applicants' mining operations and did . not address the <br />current situation in which Applicants must lower the water <br />table within the back filled West Pit and discharge that water, <br />after treatment, to the Rito Seco. (99CW057 Decree, p. 8) <br />Under both decrees, irrigation wells on the Rocky Mountain Ranch or Columbian <br />Ranch properties, owned by BMRI (appro)(mately seven miles from the West Pit area), <br />are pumped with waters piped and delivered to the Rito Seca above the Salazar Ditch <br />headgate for augmentation purposes. <br />3. 07CW42 - BMRI's Amended Application for Approval of Change of Water <br />Rights, Plan for Augmentation, and for Water Storage Right.
