(LRC, Inc.) objects to the proposed Permit Amendment 3, <br />DBMS Permit No. M-88-112, filed by Battle Mountain Gold on December 2007. <br />The Land Rights Council, Inc. does not believe that the Mined Land Reclamation ha the <br />authority to grant Battle Mountain Gold water rights to irrigate the property formerly <br />known as the Shalom Ranch, present Salazar Ranch. The MLRB cannot grant a change <br />of industrial/mining water to agricultural use. <br />The Land Rights Council contests the assertion by Battle Mountain Gold that the west pit <br />water is now of pre-mining quality. LRC fears contamination of the farmland, which is <br />adjacent to the school and the town of San Luis. <br />Further, the Land Rights Council objects to: <br />1. A proposal to close the water treatment facility located near the Rito Seco <br />Creek on the Battle Mountain Gold (BMG) property. <br />2. A proposal to irrigate the BMG property, formerly known as Shalom Ranch, <br />with water that should have been processed through the water treatment plant <br />which is currently in operation. <br />3. Any proposed changes that may be harmful to or negatively impact the <br />citizens of Costilla County, especially the town of San Luis. <br />The Land Rights Council protests that the San Luis community did not receive adequate <br />notice about the proposed amendment, as DRMI did not publish the notice in our local <br />newspaper, La Sierra and the Free Press, which would reach approximately 500 readers.
