In response, the operator provided an amended Exhibit 19, with a 2010 grading <br />deadline for the shop area, and 2012 grading deadline for the Pond 006 area, <br />which seems reasonable and sequentially appropriate. Item Resolved. <br />Review Comments Pertinent to September 29, 2008 Midterm Review Letter <br />1. The Division requested appropriate map and narrative amendments (to be <br />included within a technical revision application) addressing, clarifying, and <br />justifying proposed permanent roads and other facilities to be retained for the <br />postmining land use. <br />In response, the operator provided extensive documentation of landowner request <br />for retention of various structures, narrative explanation, and associated <br />amendments to map Exhibit 20-2, Postmining Topography and Drainage. The <br />documentation and associated text and map amendments appear to be thorough, <br />logical and responsive to Division concerns. However, inclusion of the Midterm <br />Item 1 response documentation within the on-going TR-61 application is not <br />appropriate. TR-61 as originally submitted and as described in the newspaper and <br />agency public notices, dealt solely with proposed changes to the reclamation time <br />schedule. The proposed changes with respect to permanent facilities retention and <br />associated changes to Exhibit 20-2, are of sufficient significance to warrant <br />inclusion in a separate, properly noticed technical revision application. <br />Please amend the TR-61 application submittal to withdraw proposed changes <br />associated with permanent facility retention and Exhibit 20-2 revisions, and <br />submit the subject changes within a separate technical revision application. <br />We made note of a few apparent errors or discrepancies in the materials submitted <br />pertinent to this item, which should be taken into account in the future TR <br />application: <br />• Attachment 20-2, p. 20-2.1. Should Road L be included as a segment of <br />"Landowner Access Road" in the first paragraph under Access Roads sub- <br />heading? <br />• In the third paragraph under Access Roads sub-heading on page 20-2.1, <br />there appears to be missing text at the end of the first sentence. <br />• The Lisa Ricks letter in Appendix 20-2.1 lists various facilities in addition <br />to roads and states that they are "shown on the attached figure". However <br />the figure depicts only roads, and not the various ponds, power lines and <br />fences referenced. Haul Road L is listed but not labeled on the figure. <br />Some explanation will be warranted. <br />2. In this item, the Division requested an amended Exhibit 7-1A (Hydrologic <br />Monitoring Map), to incorporate certain previously approved changes, notably the <br />location of the W-25 series monitoring wells. A properly amended map exhibit <br />was submitted. Item Resolved.
