Cattany <br />Division Director <br />Natural Resource Trustee <br />RE: Seneca II-W Mine (Permit No. C-1982-057) <br />Technical Revision No. 61(TR-61); Revised Backfilll & Grading Schedule, <br />and also Midterm Adequacy Review Responses <br />Dear Mr. Karo: <br />The Division has reviewed the above referenced submittal, received in our Grand <br />Junction Office on November 20, 2008. Our item specific review comments are set forth <br />in the enclosure. Note that we have determined that proposed changes to map Exhibit 20- <br />2 associated with TR-61 Review Item #2, should more logically be addressed within the <br />context of a separate technical revision application, along with changes responsive to <br />Midterm Review Items #1, #3, and #5 (refer to the enclosure for further explanation). <br />The electrical facility retention request submitted by Yampa Valley Electric Association <br />(YVEA), included in your letter of December 4, 2008 for insertion in Appendix 20-2.1, <br />should also be included in the future technical revision application. <br />Please submit a letter to withdraw from TR-61 the information submitted pursuant to TR- <br />61 Item #2, Midterm Review Items #1, #3, and #5, and the YVEA request. Please <br />commit in the letter, to address those Items within a separate technical revision <br />application. We would request that the withdrawal/commitment letter be submitted to us <br />by January 1, 2009, and the requested technical revision application addressing the <br />outstanding items be submitted by February 1, 2009. <br />Upon submittal of the requested withdrawal/commitment letter, the Division will proceed <br />with issuance of a proposed decision to approve TR-61.
