III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> balance issues (cut and fill quantities from the field did not completely align with those included <br /> in the estimate). A diesel tank still remained in the construction staging area, and an excavator <br /> was spreading material on a lower slope. Occasional loads were hauled from the R.O.M. pile for <br /> dumping at the East Mine. Topsoil had recently been spread down the face of what had <br /> previously been the shop and warehouse bench (Fig. 5). <br /> Pond 1 was dry and the outlet gate was open. Bin walls and abutment slopes appeared stable. <br /> The diversion ditch to Pond 2 still bore witness to the high flow thunderstorm event that occurred <br /> in July. Pond 2 was dry, although the sediment accumulated on the floor was still muddy (Fig. 6). <br /> Material has spilled from corners of the bin walls and onto the spillway (Fig. 7), leaving voids in <br /> the bin wall corners (Fig. 8). The voids in the bin wall corners should be repaired at BRL's earliest <br /> convenience. The outlet gate was in the "open" position. It appeared that water had ponded <br /> for some time in the outlet area. The West Ridge Pond and Ponds 3 and 4 were dry. <br /> Air Resource Protection <br /> It was noted that all hauling and construction activities were producing a tremendous amount of <br /> dust. Basil Bear was notified, and he said he had just spoken with the contractor about <br /> obtaining water from somewhere else, as the creek through the site was dry and there was no <br /> other source immediately available. <br /> Availability of Records <br /> The inspection concluded on the morning of 29-Oct; records were inspected at the BRL office <br /> located at the Bowie No. 2 Mine.
