Regardless of activity status of the J-Bird Mine, Bluerock Energy needs to submit the EPP and ERP <br />required by Rule 6.4.20 by February 2, 2009. The EPP submission is considered to be a conversion <br />from a 110(2) to a 1 IOd with a fee of $2,875.00. Failure to submit the EPP, ERP, and fee by February 2, <br />2009 is a violation of Rule 7.2.3(2) and may result in issuance of a Notice of Violation and the matter <br />being scheduled before the Mined Land Reclamation Board. The EPP process includes public notice <br />and multiple staff review which under the best of circumstances could be 90 days or longer if comments <br />are received. The EPP is of particular importance as Bluerock asked for and was given an extension of <br />the submission of a Technical Revision for a comprehensive stormwater management plan. The <br />extension was given in good faith by DRMS since it is to be included in the EPP. <br />Staff notes that contact information for Bluerock appears to be out of date and lists Steve Glass as the <br />primary contact.
