Cattany <br />or <br />Tom Cavanaugh Division Director <br />O&G Environmental Consulting LLC Natural Resource Trustee <br />11 Inverness Way South <br />Englewood, Colorado 8011 <br />Re: Monogram Mine, File No. M-1978-222, Completeness of 112d Hard Rock Reclamation Permit <br />Application Package for Conversion of a 110(2) permit to a 112d(1) Designated Mining Operation <br />of less than 50 acres. <br />Dear Mr. Cavanaugh: <br />On November 21, 2008 the Division of Reclamation, Mining and Safety received Nuvemco's application documentation for the <br />conversion of the Monogram Mine 110(2) permit to a 112d(1) Designated Mining Operation Hard Rock Reclamation Permit file No. <br />M-1978-222. The application appears to meet the minimum requirements of completeness for staff review. Based on the amount of <br />information for water, geo-chemical analysis and engineering that is required for a 112 DMO, the Division is calling the application <br />complex. The complex designation allows the Division an additional 60 days for review in addition to the normal 90 for a normal 112 <br />permit per Rule 1.4.1(7). Therefore, the Decision Date for this application is set for 150 days from the date of this letter which is May <br />8'', 2009. Please note that should all issues be addressed prior to the decision date and after the public comment period ends without <br />objections staff may issue a decision at that time. <br />In the event that there are objections to the permit application, the Division makes a recommendation on the application and a decision <br />would be made by the Mined Land Reclamation Board at the next scheduled board meeting. The hearing would be scheduled provided <br />Nuvemco has submitted all relevant information required by Division staff during the review process to make a qualified <br />recommendation. <br />Nuvemco must start the public comment period within 10 days of this correspondence per Rule 1.6.2(d). The notice shall be published <br />four times, once a week for four consecutive weeks. The comment period shall continue for 20 days after the last date of publication <br />per Rule 1.7.1(2)(a). Please inform staff as soon as possible by phone or e-mail of the commencement of publication and last date for <br />comments so that staff can plan the conversion review process accordingly. <br />Sincerely, <br />G.
