In November of 2007, $2,859,138 was released, leaving $115,545 <br />remaining in the Warranty. We are requesting that the remaining amount be released <br />at this time. <br />All applicable portions of the reclamation plan requirements have been satisfied in <br />accordance with the rules and all applicable requirements under the Colorado Land <br />Reclamation Act for the Extraction of Construction Materials. <br />Enclosed with this letter are: <br />1. A letter, dated November 18, 2008, from Michael A. Cunningham, <br />Environmental Protection Specialist with the Division of Reclamation, Mining <br />and Safety, stating that the requirements for Technical Revision-02 are <br />satisfied. This technical revision pertains to monitoring of the drain line north <br />of the reclaimed ponds at the site. <br />2.
