III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the operator <br /> during the field inspection. There was no snow on the ground but there was evidence that the reclaimed mine <br /> site had received a recent rain.The ground was frozen at the time of the inspection. <br /> Hydrolo�y <br /> The berm next to the river had sufficient height to keep flood waters out of the facilities area.The pipe caps <br /> were on the two alluvial wells.The collection ditch leading into the sediment pond had sufficient capacity. <br /> There was no standing water in the sediment pond.The pond embankment was stable and the pond's primary <br /> and emergency spillways were operational.The gate on the primary tube was in the closed position.The hillside <br /> spring water treatment pond had standing water to within 6 inches of the level of the horizontal pipe.The pond <br /> was discharging its usual orange colored water into the river at a rate of about 10 to 15 gallons per minute.The <br /> discharge water has been shown to be in compliance with water quality standards. The hillside spring was <br /> flowing within the channel that leads to the treatment pond. <br /> Roads <br /> The paved haul road was in good condition and was passable.There was no debris on the road.The bridge <br /> across the river was passable as well.The entrance gate was propped open. <br /> Facilities <br /> No new work had been done since the last inspection.The debris from the mine office had been hauled off so <br /> the only remaining work to do with the demolished mine office building is to break up the concrete pad,bury <br /> the concrete pad pieces along with the concrete foundation pieces,and,then,backfill and grade the shallow <br /> foundation hole. Several tires are still on site that need to be hauled offsite as well. <br /> Signs and Markers <br /> The mine identification sign and support post were located at the top of the hill but were on the ground and need <br /> to be put back up. Surface disturbance markers were up around the disturbed area.The"no trespassing"sign <br /> was up on the entrance gate. <br /> Noxious Weeds <br /> The tamarisk that was along the fence near the entrance gate had been cut down and the remaining stumps were <br /> treated.Tamarisk is still located at the hillside spring area and at the hillside spring water treatment pond and <br /> need to be dealt with. <br /> c:/word/bear3/insp 1208 <br />
