III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made:during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS. The Hawks Nest Mine is a <br /> forfeited and revoked site that was reclaimed by the State of Colorado using forfeited reclamation bond money. <br /> Since October 22, 2005,the required inspection frequency has been for one complete inspection and three <br /> partial inspections per year.There was no snow on the ground at the time of the field inspection. However,the <br /> site was wet due to a recent precipitation event.There is an east section and a west section at the Hawk's Nest <br /> Mine. <br /> Roads <br /> The only access to this revoked and reclaimed site is by the old state highway that leads from Highway 133 to <br /> the east side of Oxbow's Elk Creek Mine facilities.The old state highway was dry and passable.Debris from <br /> the two mudslides immediately adjacent to the north side of the road had recently been graded off of the road.A <br /> side road off of the old highway leads to the west section of the site.However, a parked unit train prevented <br /> access to that area.The entrance to that side road was very muddy. <br /> H dy rology <br /> Access to the sediment pond and alluvial well at the west section of the reclaimed mine site was blocked by the <br /> parked train. <br /> Both of the culverts under the old state highway at the east section of the site were clear.The riprapped channels <br /> that receive flow from the two highway culverts were in place. Also in place was the berm that runs along the <br /> downgradient end of the east section. <br /> Reclamation <br /> There were no indications of erosional instability at the east section of the site. <br /> c:/word/hawksnest/insp 1208 <br />
