M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the operator <br /> during the inspection.There was no snow on the ground but the ground was a little muddy from a recent <br /> precipitation event. <br /> Roads <br /> The Hubbard Creek road that leads to the reclaimed mine site was a little muddy but was passable.The mine's <br /> entrance road across Hubbard Creek was wet but passable.The road that leads to the reclaimed pond 5 was also <br /> a little wet but was passable as well. The entrance gate to the mine site was closed and locked. <br /> Sims and Markers <br /> Surface disturbance markers were up around the mine's disturbed area.The mine identification sign and the <br /> "records location"sign were attached to the entrance gate. <br /> Reclamation <br /> The reclaimed mine outslopes and benches showed no signs of erosional problems or slope stability problems. <br /> The reclaimed slopes and benches were well vegetated. The reclaimed coal stockpile area also was well <br /> vegetated. The reclaimed haul road showed no signs of erosional problems. <br /> Several small sections of the 18 inch diameter black plastic culvert were still at the reclaimed coal stockpile area <br /> and will be removed. Survey markers and piezometers still need to be reclaimed. <br /> The reclaimed ponds 4 and 5 showed no erosional problems. <br /> Hydrology <br /> The upper bench diversion ditch and the lower diversion ditch leading into reclaimed pond 5 had sufficient <br /> capacity and were well vegetated.The Hubbard Creek culvert was clear of debris.
