III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the <br /> operator,the Terror Creek Company, during the field inspection.The area received a soaking rain recently so <br /> the permit area was wet. <br /> Signs and Markers <br /> The mine ID signs contained the required information and were located at the main entrance,east side entrance <br /> and along the road near the railroad crossing. <br /> Roads <br /> The paved entrance road was in good condition, as was the east side graveled entrance road and the trackside <br /> light use road. <br /> HydroloQy <br /> The dugout sediment pond on the west side of the permit area was completely dry. The riprapped single open <br /> channel spillway was functional.The sediment pond on the east side of the permit area had a very small amount <br /> of standing water in it. The pond embankment was well vegetated.The grassed emergency spillway and the <br /> primary pipe were in place. The gate on the primary pipe was closed. <br /> The straw bales and silt fence along the railroad track small area exemption were in place. The sediment control <br /> ditches had sufficient capacity. <br /> Topsoil <br /> The topsoil stockpile on the west side of the permit area had a good vegetative cover.The collection/diversion <br /> berm around the stockpile was in place.The topsoil signs were up. The east side topsoil stockpile also had a <br /> good cover of vegetation on it.The stockpile's collection ditch and the diversion ditch were in place.Topsoil <br /> signs were up on this stockpile as well.There were no signs of erosional gullying on either topsoil stockpile. <br /> Facilities <br /> The inspection was conducted after the crushing and screening operations and the loading of the railcars had <br /> ended for the day. However,coal haul trucks were unloading to a coal stockpile adjacent to the grizzly. There <br /> was a fair volume of coal that was stockpiled on the facilities bench. Several railcars filled with coal were in the <br /> loading area. However,there were no signs of fugitive dust going offsite.There was a black stain on the <br /> highway at the entrance to the loadout but it was not a problem. <br /> There were no indications of any problems at the loadout office, substation,material storage area,fuel facility <br /> and the coal haul truck unloading and rail car loading structures at the loadout. <br /> c:/word/terror/insp 1208 <br />
