Response to Feb. 6, 2008 DRMS Adequacy Comments <br />Blue Pit, M-1981-207, TR-06 <br />11 February 2008 <br />Page 4 <br />new location; there will be no increase in reclamation liability as a result of the proposed <br />move. <br />To the extent that the Division requests a revision of the Reclamation Plan and cites <br />Rule 6.4.5, we emphasize that no change relevant to any paragraph or subparagraph of <br />Rule 6.4.5 is sought or indicated by the TR-06 submittal. While it may be beneficial to <br />reassess the reclamation map from both the Division and the operator perspective, this <br />would be appropriate in a future amendment process, unrelated to the current request to <br />relocate equipment in a manner that modifies a very limited number of existing permit <br />assumptions. <br />Closing Remarks <br />The submittal of TR-06 requested the Division's approval of a new location to move the <br />existing plant facility from the center of the mine, a request consistent with the overall <br />intent of the permit to move the plant during mining and involving no change to recover <br />additional resource or alter the final reclamation of Reclamation Permit M-1981-207 in <br />any way. Please understand our desire to proceed with this review in a manner that <br />accurately reflects the scope and intent of the request. <br />Given the November 30, 2007, initial submittal date for this request and the impending <br />construction season, an expedited process to complete this review would be <br />appropriate. To facilitate a final resolution of the Technical Revision, we appreciate the <br />Division's prompt communication of any needs for clarification or background <br />information.
