Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety (Division) received the Technical Revision 04 (TR-04) for the <br />Lupton Lakes Resource Pit, Permit No. M-2004-078. The Division is required to make an approval or denial <br />decision no later than March 5, 2008; therefore, your response to the following adequacy review concerns should <br />be submitted to the Division as soon as possible. <br />1. The application was submitted by Civil Resources, LLC on behalf of the City and County of Denver acting by <br />and through its Board of Water Commissioners- Denver Water and Bromley Mineral Holdings, LLC. SW <br />TKO Joint Venture, LLC holds the permit for the Lupton Lakes Resource Pit and is considered the operator <br />for the site. The Division will need a letter from SW TKO Joint Venture, LLC. authorizing this revision to be <br />submitted by entities noted above on their behalf. <br />2. Rule 6.2.1(2) requires that maps be signed by a registered land surveyor, professional engineer, or other <br />qualified person. The maps submitted to the Division were not signed. Please resubmit a signed copy of the <br />maps. <br />3. According to Civil Resources, the work will be taking place on easements held by the Colorado Department of <br />Transportation (CDOT), Mr. Michael Bradley and Mr. Ken Olgilvie. Please be aware if the applies <br />encroad i`es into any easements as a result of the mining and reclamation plan, then the applicant i>1tisfo%in <br />legal right of entry documents from the easement holders for the proposed work. Please provide legal right of <br />entry agreements in accordance with Rule 6.4.14. <br />4. Please describe in further detail how the waste rock material will be handled, stored and disposed of during the <br />construction of the dewatering outfall pipe under State Highway 85 (SH 85). Please be reminded that all <br />disturbances will need to remain within the permit area. <br />5. Please describe how the water will be routed into the new dewatering outfall pipe. Please describe, design and <br />locate any new ditches or diversions that will need to be constructed leading into the SH 85 culvert. <br />6. Aerial maps note the South Plate River in close proximity to SH 85 in the location of the outfall of the <br />dewatering pipe. Please describe how impacts to the South Platte River will be minimized with the <br />Office of <br />Mined Land Reclamation Office <br />Denver Grand Junction Durango Active and Inactive Mines
