The Division has no further concerns. Since the proposed limited extraction zone under Hubbard <br />Creek was withdrawn, page 2.05-78 was revised in the PR-11 submittal dated November 25, 2008 <br />to delete the associated mine inflow monitoring plan. <br />8. In the review of PR-10, the USDA-Forest Service approved BRL's proposed plan to longwall <br />under Dove Gulch and Dove Cave. In PR-I1, BRL has submitted a new analysis for Dove Cave <br />since the mine plan has changed. The Division will need documentation that the USDA-Forest <br />Service approves of these changes. <br />The Division has no further concerns. In an e-mail dated November 25, 2008, the USDA-Forest <br />Service approved of the PR-11 protection plan. <br />9. On proposed permit application page 2.05-119, a monitoring program to confirm the angle of <br />draw at the end of panel B-11 is described. The next paragraph states that the results of the <br />subsidence monitoring program will be submitted semi-annually. Because of the proximity of the <br />Bruce Park Dam and Terror Creek Reservoir to panel B-11, please revise the text to show that the <br />results of the subsidence monitoring program in that area will be submitted more frequently. <br />The Division has no further concerns. The submittal dated November 25, 2008 revised the <br />monitoring frequency for the panel B-11 subsidence monitoring data so that the results will be <br />reported within 30 days of the monitoring data collection. The commitment is on revised page <br />2.05-122. <br />10. There are three locations in the permit application text where the words 'panels B-12 and B-13 " <br />should be changed to "panel B-I1. " The first is on page 2.05-108 and the other two are located <br />in the subsidence monitoring table on page 2.05-123. Please provide revised permit application <br />pages. <br />The Division has no further concerns. The requested changes were made to revised pages 2.05-109 <br />and 2.05-126 in the submittal dated November 25, 2008. <br />11. On proposed Map 27, please label which longwall panels are 8B, 9B, JOB and JIB. <br />The Division has no further concerns. Map 27 was revised accordingly in the November 25, 2008 <br />submittal. <br />Agency and Public Responses <br />12. In a letter dated April 14, 2008 and in the Division's adequacy review letter dated May 12, 2008, <br />the Division forwarded three comment letters to BRL concerning the PR-11 submittal. Attached <br />are three additional comment letters concerning PR-11. <br />A. Letter from the USDA-Forest Service, dated September 30, 2008, concerning <br />inaccessibility for a down gradient monitoring well. <br />B. Letter from the USDA-Forest Service, dated September 30, 2008, in which that agency <br />provided its consent and concurrence for PR-11 for lands included in the recently <br />3
