Permit Revision No. 11, Northern Extension of B-Seam Mine Plan, Second Adequacy Review
Dear Mr. Bear:
The Colorado Division of Reclamation, Mining and Safety (Division) has finished its adequacy review of
Bowie Resources LLC's (BRL) responses dated November 25, 2008 to the Division's adequacy review
letter dated May 12, 2008 for Permit Revision No. 11 (PR-11) for the Bowie No. 2 Mine. A copy of the
approved federal lease modification with attachment A was included in BRL's November 25, 2008
submittal. Items numbered 1,2 and 6 remain active.
The review of PR-11 focused on the revised mine plan change as well as on the Federal Coal Lease COC-
61209 modification. The issue of mining within one mile of the Bruce Park Dam and the Terror Creek
Reservoir and the issue of down gradient ground water wells were resolved in PR-10.
The following are the Division's questions and comments.
Rule 2.03
The Division will conduct an Applicant Violator System (A VS) computer check of the Bowie No. 2
Mine permit during this adequacy review period. The Division will conduct similar AVS checks at
the time of the Division's proposed decision and at issuance time for PR-11. The Division will
inform BRL of the results.
The Division conducted an AVS check for completeness and the system recommendation was to
issue. Additional AVS checks will be conducted just prior to the proposed decision and issuance
dates.
Rule 2.04
As had been acknowledged in the BRL PR-11 cover letter and as had been requested in the
attached Colorado Historical Society (CHS) comment letter dated February 20, 2008, please
provide a cultural resource survey for the federal lease modification area. The Division will
forward a copy to the CHS for their review.
In a submittal dated November 28, 2008, the Division sent a copy of the cultural resources survey
to the CHS for their review. A copy of CHS's written responses to the survey will be forwarded to
BRL when they are received by the Division.
